Derby Clean Indoor Air Ordinance
Message from the City of Derby to Business Owners & Employers
Dear Derby Business Owner/Employer:
On April 10, 2007, Derby’s Mayor and City Council passed the Derby Clean Indoor Air Ordinance (Ord. #1885). The purpose of the ordinance is to:
(1) improve and protect the public’s health by eliminating smoking in enclosed public places and places of employment;
(2) assure nonsmokers of the right to breathe smoke-free air while indoors;
(3) and recognize that the need to breathe smoke-free air shall have priority over the choice to smoke.
The ordinance is effective January 1, 2009. Beginning January 1, 2009, smoking is prohibited in all enclosed public places and places of employment in Derby and within 20 feet of entrances, exits, and air intake ventilation systems. Licensed premises are exempt from the ordinance until the City of Wichita passes a similar prohibition; however, owners of licensed premises may choose to go smoke-free at any time.
A public place is any place that the public is allowed or invited into including retail stores, professional offices, home day care, public transportation, restaurants, etc. A licensed premises is any establishment that obtains a cereal malt beverage (CMB) or liquor license for consumption on the premises.
To assist business owners and employers in complying with the law, the following items are enclosed for your convenience:
- Derby Clean Indoor Air Ordinance (Ord. #1885).
- Brochure outlining how employers, business owners, and the public can comply with the Derby Clean Indoor Air Ordinance. The brochure will also be distributed through various community sites to inform individuals about the effect of the ordinance.
- Sample smoke-free workplace policy, which may be adapted for your use. Employers and business owners may create their own policy in a different style and format, as long as it accurately reflects the provisions of the new law. This policy must be in writing and communicated to all employees prior to the smoking restriction ordinance going into effect.
Please also be advised that the ordinance requires the posting of signs at each entrance reading “No Smoking” (minimum one-inch lettering) or signs with the international no smoking symbol. FREE signs are available to print at your convenience here.
